My comment:
(a) This is a slip opinion or advance sheet, both are the same in Massachusetts appellate court. Released at the time of issuance of the decision in a single copy about a single case, it is subject to revision (of wording, etc).
(b) Massachusetts officially identifies itself as a commonwealth, not a state.
(c) FN2 = footnote 2
(d) I believe the decision correctly interprets the pertinent state law.
(e) Legislator leaders and prosecutors in the state are outraged. They vow to amend the law as soon as possible. However:

"At least two bills introduced in the Legislature in recent years could have made the practice of upskirting illegal, but the legislation went nowhere, according to a review of the bills."
