(b) In the case Lin v United States, 561 F.3d 502 (CADC 2009), cert denied _ US _ (2009)

had ruled that whether Taiwanese are entitled to a US passport is a political question that a US court may not get involved. The Taiwan case was cited by parties in the Zivotofsky case. Reading the supreme court decision, it is clear that the Lin case can not revived based on yesterday's deciision--because US Congress has not directed the Executive branch to do so, thereby distinguishing the cases (Lin and Zivotofsky).
