My comment:
(i) That was yesterday's news.
(ii) Fourteenth Amendment indeed applies to states only, but the Fifth Amendment (whose due process cluase has an equal protection element) does apply to the US government. The problem mainly lies in lack of a cause of action (Congress has not creatred one)--and a sovereign (such as US or foreign governments, or their heads like President Hu Jintao who Falun Gong wanted to sue but could not) is immune from lawsuit, something called sovereign immunity.
