Note:
(a) "says IBM in a new court filing * * * The complaint, filed Tuesday in State Supreme Court in New York County, follows by a day GlobalFoundries own pre-emptive filing that sought to dismiss IBM's demand that it repay $2.5 billion."
(i) IBM filed a new, separate lawsuit against GlobalFoundries, in the same state court, contrary to what I thought: that IBM filed a counterclaim against GlobalFoudries in the SAME case GlobalFoudries had filed a day earlier. However, the result will be the same, as the two cases will be consolidated (that is, one case will be ignored (to be selected by a judge who will be assigned to both cases) while both parties fight in the other case).
(ii) The case is
