     中国著名维权NGO"公盟“的负责人许志永近日正式被北京市检察机关以涉嫌 “偷税罪”批准逮捕。
     今天（8月18日）日，北京市公安局办案警官通知了许志永的辩护律师周泽，称已许志永已经被正式批捕，正式的逮捕通知书已经寄出到许志永的任教单位北京邮电大学，但周泽律师还没看到逮捕通知书原件。
      周泽告诉本台记者，许志永的兄长委托他担任许志永的律师，而之前许志永也表达过这样的意愿。在上周五（8月14日），周泽在北京市第一看守所会见了许志永，除了讨论案情外，周泽还将授权委托书原件提交警方，希望警方转交许志永签署。
      此前，许志永等人创办的公盟，因为税务问题，分别被北京市地税和国税局课以五倍的罚款，当公盟募集款项希望付清税款和罚款时，却被地税和国税方面以“没有法定代表人签名”而拒收，而此时，许志永已经被警方拘留，无法签字。
     公盟只得陆续以汇款方式将55万罚款汇到税务局的账户，今天上午，公盟又汇出了15万。下午，警方通知周泽前往领取许志永的缴税委托书。
     根据今年2月28日修订后的现行中国《刑法》，其201条规定，偷税罪是“纳税人采取欺骗、隐瞒手段进行虚假纳税申报或者不申报”，最高可处七年徒刑。
     该条又规定，“经税务机关依法下达追缴通知后，补缴应纳税款，缴纳滞纳金，已受行政处罚的，不予追究刑事责任。”

[<tbody>[<tr> [<td> 以目前所了解的情况看，许志永先生及公盟（实际上是一个公司形式注册的法人实体）充其量是漏税。许先生对于税务方面的补缴和罚款决定有异议，没有“缴纳”，于是被羁押，现在又被逮捕。
　　对于“罪”与“非罪”的区分，应该是严格而且清晰有效的。
根据刑法201条的相关规定以及司法实践中的案例（当然，在中国案例是可以“无视”的），许先生没有主观逃避缴纳税款的故意，没有伪造、变造、藏匿、擅自销毁帐目记录及相关凭证，没有虚列开支，没有隐匿收入，无虚假申报行为，仅仅是对于一部分收入是否应该纳税有异议。如果最终对于这部分收入是否应该纳税有一个明确的界定，充其量许先生是“漏税”，属于“一般违法行为”而不是“犯罪”，处罚办法是“行政处罚”，处罚方式是“补缴漏缴的税款和加收滞纳金”。
　　博主所言的，“经税务机关依法下达追缴通知后，补缴应纳税款，缴纳滞纳金，已受行政处罚的，不予追究刑事责任。”这一条款适用条件是：偷税数额占应纳税额的百分之十以上不满百分之三十并且偷税数额在一万元以上不满十万元的。如果单独使用，恐与刑法原意不同。
　　从现行法律框架看，许先生当无大碍。然而，当局醉翁之意不在酒，现行法律只不过是一个任人打扮的娼妇而已。唯有大哭三声，大笑三声。

[<tbody>[<tr> [<td>以目前所了解的情况看，许志永先生及公盟（实际上是一个公司形式注册的法人实体）充其量是漏税。许先生对于税务方面的补缴和罚款决定有异议，没有“缴纳”，于是被羁押，现在又被逮捕。
　　对于“罪”与“非罪”的区分，应该是严格而且清晰有效的。
根据刑法201条的相关规定以及司法实践中的案例（当然，在中国案例是可以“无视”的），许先生没有主观逃避缴纳税款的故意，没有伪造、变造、藏匿、擅自销毁帐目记录及相关凭证，没有虚列开支，没有隐匿收入，无虚假申报行为，仅仅是对于一部分收入是否应该纳税有异议。如果最终对于这部分收入是否应该纳税有一个明确的界定，充其量许先生是“漏税”，属于“一般违法行为”而不是“犯罪”，处罚办法是“行政处罚”，处罚方式是“补缴漏缴的税款和加收滞纳金”。
　　博主所言的，“经税务机关依法下达追缴通知后，补缴应纳税款，缴纳滞纳金，已受行政处罚的，不予追究刑事责任。”这一条款适用条件是：偷税数额占应纳税额的百分之十以上不满百分之三十并且偷税数额在一万元以上不满十万元的。如果单独使用，恐与刑法原意不同。
　　从现行法律框架看，许先生当无大碍。然而，当局醉翁之意不在酒，现行法律只不过是一个任人打扮的娼妇而已。唯有大哭三声，大笑三声。
　　PS：因对许先生案情了解尚少，无法作出关于案情本身进一步的评论，待细节了解充分时，也许会单发一贴对许先生表示支持
