(b) Its significance, which the obituary fails to point out, is Supreme Court applied United States Constitution to the states for the first time. Until then, it had been thought that the Constitution was a constraint on federal government only. In Mapp, Supreme Court held the Constitution was applicable to the state, thanks to two clauses of the Fourteenth Amendment (adopted in 1868): "nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws."
